1. Agreement
By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization. If you do not agree, do not use the Services.
2. Eligibility
You must be at least the age of majority in your jurisdiction, or use the Services under the supervision of a parent or legal guardian. The Services are offered to both businesses and individuals.
3. Accounts
You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for all activity under your account. Notify us at info@olsisoft.com of any unauthorized use.
4. License to use the Services
Olsisoft grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal use, subject to these Terms and any applicable plan or order.
5. Open-source and product licensing
Certain components of StreamFlow and Pulse are distributed under their own license terms (including source-available and Apache-2.0 releases). Those license terms govern the corresponding components and prevail over these Terms for that specific use.
6. Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to derive source code except as permitted by applicable law or an applicable open-source license;
- use the Services to violate any law, infringe third-party rights, or transmit malware;
- interfere with, overload, or attempt to gain unauthorized access to the Services;
- resell, sublicense, or provide the Services to third parties without written authorization.
7. Fees and payment
Paid plans are billed according to the pricing displayed at purchase. Fees are non-refundable except where required by law or explicitly stated. Taxes are your responsibility.
8. Beta and early-access features
Features labeled "beta", "early access", or "preview" are provided as-is, may change or be discontinued at any time, and are excluded from any service commitments.
9. Intellectual property
Olsisoft retains all rights, title, and interest in and to the Services, including trademarks, logos, documentation, and software, except for rights expressly granted to you. You retain all rights to the data and content you submit through the Services.
10. Your data
Your use of the Services is also governed by our Privacy Policy. You are responsible for the lawfulness of the data you process through the Services.
11. Third-party services
The Services may interoperate with third-party products, APIs, or infrastructure providers. Olsisoft is not responsible for third-party services and their terms apply to your use of them.
12. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, Olsisoft's total aggregate liability arising out of or related to the Services shall not exceed the greater of (a) the fees paid by you to Olsisoft in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD 100). Olsisoft shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.
14. Indemnification
You agree to indemnify and hold harmless Olsisoft from any claims arising out of your use of the Services in violation of these Terms or applicable law.
15. Suspension and termination
Olsisoft may suspend or terminate access to the Services at any time if you breach these Terms or if required by law. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.
16. Changes to the Services or Terms
Olsisoft may modify the Services or these Terms. Material changes will be reflected by updating the "Last updated" date. Continued use after changes constitutes acceptance.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, excluding conflict-of-law rules. Exclusive jurisdiction lies with the competent courts of Quebec, Canada, without prejudice to any mandatory consumer protection rights.
